Does UAE Labor Law Guarantee Maternity Leave for Female Employees, Even If Their Contract Doesn’t Include It?

Maternity leave is a fundamental right in the UAE, ensuring female employees are protected during and after pregnancy. UAE labor laws are designed to safeguard employees’ rights, with a strong focus on the well-being of working mothers. This article explores the UAE Labor Law’s provisions on maternity leave, addressing whether these rights apply even if not explicitly mentioned in an employment contract. 

What is Maternity Leave? 

Maternity leave allows a female employee to take time off to recover from pregnancy and childbirth. It applies regardless of the baby’s survival and ensures a mother can focus on her health and well-being during this critical time. 

The Legal Framework: Federal Decree-Law No. 33/2021 

The UAE Labor Law, through Federal Decree-Law No. 33/2021, provides comprehensive protections for female employees, including maternity leave. These statutory rights ensure that no contractual provision can undermine maternity leave benefits, making them obligatory for all employers in the UAE. 

Maternity Leave Entitlements: Article 30 

Under Article 30 of the Decree-Law, female employees are entitled to the following: 

  • 60 Days of Maternity Leave
  • 45 days at full pay 
  • 15 days at half pay 
  • Extended Leave for Medical Reasons: Up to 45 additional unpaid days can be granted for pregnancy or childbirth-related illnesses, provided medical certification is supplied. 
  • Childbirth Complications: For a sick or disabled child, an extra 30 days of fully paid leave is granted, with the option for another 30 days without pay. 
  • Right to Breastfeeding Breaks: Upon returning to work, a female worker is entitled to breastfeeding breaks, which can total up to two hours daily for six months after childbirth. 

Nullification of Contrary Contractual Conditions: Article 65 

Article 65(3) nullifies any contractual terms that attempt to reduce or eliminate maternity leave rights unless the terms are more beneficial to the employee. This protection guarantees that female workers’ rights prevail over any unfavorable contractual provisions. 

Conclusion 

The UAE Labor Law unequivocally guarantees maternity leave to female employees, regardless of whether it is specified in their employment contracts. This statutory protection ensures that all female workers can take maternity leave without fear of losing their job or being disadvantaged by their contract terms. Employers must fully comply with these provisions to foster an inclusive and supportive work environment.
