𝗦𝗵𝗼𝘂𝗹𝗱 𝗽𝗮𝗿𝗲𝗻𝘁𝘀 𝗮𝗽𝗽𝗼𝗶𝗻𝘁 𝗼𝗻𝗲 𝗴𝘂𝗮𝗿𝗱𝗶𝗮𝗻 𝗶𝗻 𝘁𝗵𝗲 𝗨𝗔𝗘 𝗮𝗻𝗱 𝗼𝗻𝗲 𝗼𝘂𝘁𝘀𝗶𝗱𝗲 𝘁𝗵𝗲 𝗨𝗔𝗘 𝗶𝗻 𝗮 𝗗𝗜𝗙𝗖 𝗪𝗶𝗹𝗹?

It sounds like a small drafting point.

It is not.

For non-Muslim parents in Dubai or Ras Al Khaimah, a DIFC Will can do more than deal with assets. It can also appoint guardians for minor children. This is especially important because guardianship is not just about “who do I trust most?” It is also about who can practically step in immediately if something happens.

This is where the debate starts.

Many parents instinctively want to appoint a close family member abroad as guardian. A sibling in the UK. Parents in Europe. A trusted relative back home.

Emotionally, that may make perfect sense.

Practically, it may create a gap.

If both parents pass away or become unavailable, who is physically present in the UAE to collect the child from school, deal with the authorities, access documents, manage urgent medical decisions, and keep the child safe until the long-term guardian arrives?

This is why, in many cases, it can be sensible to consider:

𝟭. 𝗔 𝗨𝗔𝗘-𝗯𝗮𝘀𝗲𝗱 𝗶𝗻𝘁𝗲𝗿𝗶𝗺 𝗴𝘂𝗮𝗿𝗱𝗶𝗮𝗻 Someone trusted, available, and physically present in the UAE who can act immediately in an emergency.

𝟮. 𝗔𝗻 𝗼𝘃𝗲𝗿𝘀𝗲𝗮𝘀 𝗹𝗼𝗻𝗴-𝘁𝗲𝗿𝗺 𝗴𝘂𝗮𝗿𝗱𝗶𝗮𝗻 Someone who may ultimately raise the child, relocate them, or take over permanent care once the urgent UAE-side arrangements are handled.

But here is the important part: appointing more people does not automatically mean more protection.

If the Will is unclear, parents may unintentionally create confusion over who has authority, when each guardian’s role begins, whether they act jointly or separately, and what happens if they disagree.

A “backup plan” only works if it is actually workable.

In my view, the strongest guardianship clauses are not the ones with the most names. They are the ones that clearly answer:

Who acts immediately? Who acts long-term? What happens if one person is unavailable? Does the guardian understand the legal and practical responsibility? Is the arrangement realistic for the child’s location, school, visa, family structure, and nationality?

A DIFC Will is not just a formality. It is a crisis document. It should be drafted as if it may one day need to work under pressure.
