Well-Known vs. Notorious Trademarks in Europe

In Europe, two types of trademarks are distinguished: well-known trademarks and notorious trademarks

  • A well-known trademark is a registered mark recognized widely beyond the country where it is registered. Its reputation extends across borders and is associated with various products or services. For example, the Rolling Stones logo is a recognized well-known trademark. 
  • A notorious trademark, however, is not registered but has gained recognition through widespread use. It becomes so iconic that it doesn’t need registration for protection. A classic example is Coca-Cola, which, in many countries, is immediately recognized by its name and logo, even without registration. 

Article 6bis of the Paris Convention for the Protection of Industrial Property addresses notorious trademarks but leaves their definition to the discretion of national authorities. Consequently, a trademark recognized as notorious in one country may not be recognized in another. 

The Strength of Well-Known Trademarks

  1. Well-known trademarks enjoy enhanced protection across all product categories, unlike standard trademarks, which are protected only in the categories they are registered under. This means that a well-known trademark like Nike’s “JUST DO IT” is protected across all industries, not just sportswear. 

    To qualify as a well-known trademark, the following must be demonstrated: 

    • Significant public recognition beyond the registered jurisdiction. 
    • Extensive use, market share, geographical reach, and promotional investments

    For notorious trademarks, reputation alone is sufficient for protection, even without formal registration. 

    Trademark Protection in the UAE 

    In the UAE, Federal Decree Law No. 36 of 2021 governs intellectual property and provides protection for well-known trademarks. Article 4 of the law defines a well-known trademark as one whose reputation exceeds the borders of the country where it is registered. However, unlike Europe, the UAE does not distinguish between well-known and notorious trademarks. 

    The law protects well-known trademarks only for similar goods or services, which may limit their scope compared to European standards. In Europe, these trademarks enjoy protection across all categories, regardless of similarity to the registered goods or services. 

Implications and Future Developments in the UAE

Given that the UAE’s IP laws are relatively recent, with the latest trademark law introduced in 2021, judicial interpretation on well-known trademarks is still evolving. While UAE courts have yet to fully explore the scope of well-known and notorious trademarks, it is expected that as Dubai and other emirates like Ras Al Khaimah continue their rapid growth, legal precedents will develop. 

Since the UAE is a signatory to the Paris Convention, it is reasonable to expect that notorious trademarks will also receive similar protection under UAE law, as they do in Europe.
