According to Article No. (7), either spouse can initiate divorce proceedings without the need to establish fault, specify harm, or assign blame. The law’s streamlined approach is expected to facilitate a more efficient divorce process. The submission of a divorce request to the court is designed to prompt a swift legal response, leading to an expedited court decision after due notification of the other party.

 

Choice of Law for Foreign Residents

A critical aspect, often misunderstood, is the law’s applicability to foreign residents in the UAE. While the law provides a new framework for personal status matters, it is not automatically binding on foreign residents. As per Article No. (1), foreign residents have the option to either adhere to the Federal Decree-Law No. (41) of 2022 or to apply the personal status laws of their home country with respect to marriage, divorce, inheritance, wills, and proof of parentage. The only exception pertains to procedures related to the opening and distribution of estate files and wills registration, which must follow UAE law.
